was just looking at what kernel i have on my 1043nd and it's 3.3.8 just wanted to no if the kernel can be bumped to 3.5 because of "bufferbloat".

I do no that Gargoyle is built on the aa branch of openwrt dus that limit Gargoyle to using kernel 3.3.8?

fq_codel was backported to 3.3.8 for openwrt AA, which is the key to addressing bufferbloat. No idea how to enable it on gargoyle, but theoretically it's supported in the kernel. So merely getting 3.5+ installed isn't going to do much for you.

More on this often discussed topic can be found here

However, Gargoyles ACC already control bufferbloat on your WAN link so expect no improvement there.
