You enter 95% of your upload speed on the upload QoS screen. That is the standard recommendation. Without that QoS may not work. To get QoS to work you have to sacrifice some bandwidth. How fast are your upload and download speeds? What did you set your upload and download to in QoS?

Have you tried disabling Gargoyle's ACC feature to see if that alleviates the problem? Does this issue affect all Battlefield 3 servers you play on?

Why would you want to limit your max download on your Xbox? You should give your gaming machine a decent-size MINIMUM bandwidth, and leave maximum bandwidth off.
